Minute Entry for proceedings held 10/4/2018 before Hon. Richard J. Arcara. Status Conference is held. The Court calls counsel`s attention to a situation which may be of concern to the parties. The Court`s confidential law clerk assigned to this matter is engaged to be married to an associate at defense counsel`s law firm; the confidential law clerk will be leaving the Court in approximately two months for another employment opportunity. The Court takes a recess to allow counsel an opportunity to consider this situation. Proceedings resume. Pltfs` counsel suggests to the Court that this matter be assigned to the Court`s other law clerk. Due to the other law clerk`s workload, this is not a feasible option. Pltfs` counsel asks for a short adjournment to discuss this with his clients. A further status conference is scheduled for 10/9/2018 at 8:45 AM. As to the claim construction hearing scheduled for 11/6/2018, neither side will be calling witnesses. Appearances: Pltfs - Michael Berchou; Deft - Robert Fluskey and Charles Rauch (Court Reporter Wendy Herman, Jack W. Hunt & Associates, Inc., Buffalo, NY; telephone: (716) 853-5600.) (DJD) (Entered: 10/09/2018) |
Minute Entry for proceedings held 10/9/2018 before Hon. Richard J. Arcara. Status Conference is delayed due to Pltfs` counsel`s unexpected absence as a result of heavy traffic. Counsel for Deft returned to his office pending Pltfs` counsel`s availability. Upon informal advice from Pltfs` counsel, the Court held a status conference without counsel in attendance to report the following: Pltfs have given consideration to the Court`s confidential law clerk situation. Pltfs are not comfortable with the law clerk issue. Therefore, the Hon. Richard J. Arcara recuses himself from this matter and returns it back to the Clerk`s Office for reassignment. Appearances: Pltfs - No appearance; Deft - No appearance (Court Reporter Megan Pelka.) (DJD) (Entered: 10/09/2018) |
